1. Agreement and eligibility
These Terms form an agreement between you and Kyshe, LLC, operator of Flairword. By using Flairword, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service.
You must be at least 13 and legally able to enter this agreement. If you use Flairword for an organization, you represent that you may bind that organization.
2. Accounts and service access
Public browsing, remixing, and square downloads may be available without an account. An account is required for custom generation, cloud saves, subscriptions, and certain formats. You are responsible for accurate account information, safeguarding access to your email and authentication provider, and activity under your account.
Features, limits, backgrounds, formats, and prices may change. We may suspend or limit access to protect users, investigate abuse, comply with law, maintain the service, or enforce these Terms.
3. Prompts, generated content, and card assets
You retain any rights you have in text and other material you submit. You give us a limited license to host, process, reproduce, and transmit that material as necessary to operate, secure, and improve Flairword and fulfill your requests.
Flairword uses artificial intelligence to produce original quote candidates. AI output can be inaccurate, repetitive, unexpected, or unsuitable. Review every generated work and design before relying on, publishing, or sharing it. Generated output is not professional, medical, legal, financial, or mental-health advice.
Subject to these Terms, you may download and share cards for lawful personal use. Commercial rights, exclusivity, trademark clearance, and copyright protection are not guaranteed. Rights in fonts, photographs, illustrations, and other third-party assets may be subject to separate licenses or restrictions. Do not claim that generated words were spoken by a real person without reliable verification.
4. Flairword Pro, billing, and cancellation
Pro subscriptions are billed in advance through Stripe on a monthly or annual recurring basis. The price, billing interval, included generation allowance, and applicable taxes are shown before checkout. Allowances reset according to the billing period and do not roll over unless expressly stated.
Subscriptions automatically renew until canceled. You may cancel through Manage billing in your account. Cancellation normally takes effect at the end of the paid period; access continues through that period unless the law or Stripe requires otherwise. Except where required by law, payments are nonrefundable and we do not provide credits for partially used periods. Contact us promptly if you believe you were charged in error.
We may change subscription prices or benefits with advance notice when required. A price change applies no earlier than your next renewal after the notice period.
5. Acceptable use
You may not use Flairword to:
- Break the law, violate another person's rights, or evade applicable platform or provider policies.
- Generate or distribute hateful, harassing, exploitative, sexually abusive, fraudulent, defamatory, or violent content.
- Impersonate a real person, fabricate endorsements, misattribute quotations, or mislead people about a card's source.
- Probe, disrupt, scrape at unreasonable volume, reverse engineer, bypass usage limits, share account access for abuse, or interfere with security controls.
- Upload confidential, sensitive, infringing, or personal information you are not authorized to use.
We may moderate prompts and output, reject requests, remove content, or suspend accounts that violate these Terms or create risk.
6. Ownership and feedback
Flairword, its interface, brand, software, templates, and curated collections are owned by Kyshe, LLC or its licensors. These Terms do not transfer our trademarks or service technology. If you send feedback, you allow us to use it without restriction or compensation.
7. Disclaimers and limitation of liability
Flairword is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim implied warranties, including merchantability, fitness for a particular purpose, noninfringement, and uninterrupted or error-free operation.
To the fullest extent permitted by law, Kyshe, LLC and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, reputational harm, or losses caused by reliance on generated content. Our aggregate liability for a claim relating to Flairword will not exceed the greater of $100 or the amount you paid us in the 12 months before the event giving rise to the claim. Some jurisdictions do not allow certain exclusions, so they may not apply to you.
8. Changes, termination, and general terms
We may update these Terms as Flairword changes. Material changes will receive notice when required. Your continued use after the effective date means you accept the revised Terms. You may stop using Flairword at any time. Provisions that by their nature should survive termination will survive.
If part of these Terms is unenforceable, the rest remains effective. Our failure to enforce a provision is not a waiver. Applicable consumer-protection rights are not limited by these Terms. These Terms are governed by the laws applicable where Kyshe, LLC is organized, without overriding mandatory rights in your home jurisdiction.
